Provider's Registration - Terms of Use

This Provider Portal Terms of Use Agreement ("Agreement") is a legal agreement between you and ReliaCare Alliance IPA, LLC. ("ReliaCare") governing your use of this website (the "site").

In order to secure access privileges to Provider Portal, you must abide by the Terms of Use and are required to consent to the following terms. You will acknowledge consent at the end of this disclosure by clicking the Agree to Terms of Use box. Access will be denied without consent.


This Agreement does not establish any relationship of partnership, joint venture, employment, franchise or agency between you and us.
  1. You have verified that you are a health care provider, or are employed by or on staff with a health care provider contracted with a health plan for which ReliaCare provides services ("You"). If you are employed by or on staff with a physician/provider, you (User) verify that you are authorized by that physician/provider on his, her, or its behalf to use Provider Portal.
  2. 2. You/User agree that by permitting you with access to this site you will maintain best practices with respect to the physical and technical security of your terminals, computer system, user identification, password, and other private or confidential information relating to your use of the Provider Portal. You are required to comply with HIPAA privacy provisions in relation to Individually Identifiable Health Information (IIHI) and Protected Health Information (PHI).
  3. 3. You/User are prohibited from retrieving or attempting to retrieve information from the Provider Portal about patients who are not receiving services from yourself or your respective practice.
  4. 4. You/User acknowledge that information gained through Provider Portal is highly sensitive confidential health information and the unauthorized use or disclosure of this information may lead to criminal or civil penalties and/or loss of a professional license. The protection afforded to this health information attaches in the electronic or hard copy format.
  5. 5. You/User agree that by permitting you access to this site, ReliaCare cannot and does not guarantee or warrant that files available for downloading will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. Contracted Provider and User are responsible for implementing sufficient procedures and checkpoints to satisfy your requirements for accuracy of data input and output, and for maintaining a means for the reconstruction of any lost data.
  6. 6. You/User may only retrieve information from the Provider Portal for patients cared for by you or your practice and on behalf of you or your practice. You understand and acknowledge that you may retrieve information only for purposes of providing health care treatment, planning, quality assurance, or physician review services involving patients of yours or your practice.
  7. 7. You/User agree not to reverse engineer, reverse assemble, or reverse compile any component of the Provider Portal, ReliaCare's proprietary computer databases, programs, or any confidential information whatsoever.
  8. 8. You/User are responsible for advising ReliaCare of changes in personnel's right of access to Provider Portal preferably within 1 business day but no later than 10 business days of such change to enable ReliaCare to activate or terminate access in order to appropriately protect the data.
  9. 9. You/User agree that an individual account and password shall be for the purpose of individual use and not used in common by a group of individuals. This is required to provide individual accountability for the determination of who accessed what resources and for what purpose, and so that ReliaCare can establish inappropriate use of an account and password.
  10. 10. You/User agree that you will be required to change your password every 6 months and more frequently if you suspect that a password has been compromised or shared with someone else.
  11. 11. You/User agree you share the responsibility with ReliaCare to provide a secure website for your use and to maintain accurate and current account for Users. Therefore, Users understand that atrophied accounts (accounts never used 120 days after creation and not used for 120 days since last login) will be suspended. If you should need to use your account again after this period of disuse, you may re-register for access to the Provider Portal and ReliaCare will reestablish you as a User.
  12. 12. You/User understand that there is a twenty (20) minute timeout policy and practice. If you have established a connection to the Provider Portal but are not actively using it (screen movement), User will be automatically disconnected after 30 minutes. The timeout interval provides security for Users who forget to log out. Timeout practice also helps the performance of the web server by freeing the resources dedicated to that User's connection, thus freeing system resources to be available to others.

License and Website Access

Users under the age of eighteen (18) are prohibited from using the site. We hereby grant you a personal, non-exclusive, non-transferable, revocable license to access our site and the information contained within the site provided that you are not under the age of eighteen (18). You may not assign or sublicense this license. The site and information contained within the site may not be distributed, modified, reproduced, transmitted or used commercially in whole or in part without ReliaCare's written permission, except you may make a limited number of copies for your own personal, noncommercial use.

ReliaCare's Provider Portal contains software tools and databases that allow you to search and retrieve information. You may not (1) sell, distribute or commercially exploit such software tools, databases or the results of any database search performed on this site, (2) use any data mining, robots, or similar gathering and extraction tools, or (3) sell, rent, lease, lend, or transfer any services provided on this site.

You may use our services for lawful purposes only.

You may not use our services to post, transmit or otherwise distribute unlawful material. Examples of unlawful material include, but are not limited to, threats of physical harm, defamatory statements, pornographic material, and copyrighted, trademarked, and other proprietary material used without proper authorization. You may not attempt to use or distribute tools designed for compromising security or take action to compromise the security of this site. Examples of these tools include, but are not limited to, password guessing programs, cracking tools, or network probing tools. You may not "flood" or disrupt our site through any means or process. You are responsible for all use of our services and our site, with or without your consent, by yourself and others, which occurs by, through, or in connection with access to our site via your computer.


In order to use our website, each user must first complete the registration process. This information is intended to support our health plans, their members, and providers by authorizing user access to the site and to enable user contact regarding services and features available on this site. It is not used for any other purposes; the data is not sold. During registration a user is required to give the following contact information:

Usernames and Passwords

In order to access ReliaCare's Provider Portal, you have requested a Personal Username and Password. We require a Username and Password as part of a verification system designed to protect your privacy and security. You are not required to select a Username and Password, but if you choose to do so, you are responsible for maintaining its security.


ReliaCare uses cookies to facilitate the sign-in process for you across multiple applications on the site. Cookies give users a special, random ID -- that is a small text file, which is stored on the hard drive of a user's computer. Cookies can make the Web more useful by storing information about your preferences on a particular site. The use of cookies is an industry standard, and many major web sites use them to provide useful features for their customers.

Please note: Nothing in a cookie allows anyone to identify you individually. Your computer is assigned a number and that number is stored using the cookie. This number is only meaningful in the context of our secure database system and your personalized version of our website.

Interactive Areas

ReliaCare is not responsible for information that is voluntarily provided by the user in interactive areas (i.e. discussion groups, message boards, on-line chats). Information divulged through these mediums may in fact increase future solicitations by people or companies not affiliated with ReliaCare. Be aware that if you are in a public forum you should adjust your actions appropriately.


ReliaCare provides links to other Internet sites maintained by third parties. When you click on these links, you are moving to another web site. Please be aware that ReliaCare is not responsible for the privacy practices of other sites. ReliaCare encourages our users to be aware when they leave our site and to read the privacy statement of each and every site, as their policies may be different from ours. This privacy statement applies solely to information collected by the ReliaCare website.

Log Files

ReliaCare employs the User ID to analyze trends and audit the application use for performance purposes.


To prevent unauthorized access and maintain data integrity, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. ReliaCare uses encryption that is 128 bit (Secure Sockets Layer) SSL with a key that is certified. This encryption is indicated by a small lock symbol in the bottom left part of the frame of a Netscape web browser or along the bottom edge, about two thirds of the way over to the right side, on a Microsoft web browser. SSL encryption for this piece means that the data stream that travels from the web server to the destination browser cannot be interpreted by anyone other than the user. The other benefit gained from SSL (as a result of the certification) is the authentication of the connect site to the user. The user can read the name and identifying information that is an integral part of the key, see that a major certifying authority has verified its authenticity, and know that they are truly attached to the ReliaCare site and not an imposter site. SSL is the industry standard form of encryption for the web, and is used by many sites including almost all credit card shopping carts and banking/financial web applications.

Notification of Changes

Any changes to ReliaCare's privacy policy will be posted on our website so users can always be aware of the information we collect, how we use it, and under which circumstances, if any, we disclose it. If at any time we intend to use personal information in a manner different from what was stated when it was collected, we will first notify the user by email. The user will maintain the right to decide if we are allowed to use the information in this manner. We will only use collected data in accordance with the privacy policy that was in effect at the time the information was collected. Limitation of Liability

ReliaCare will not be liable to you or anyone else for any harm to you or others resulting from the use of our site and/or the products and services provided through our site. To the maximum extent permitted by law, in no event will we be liable to you or anyone else for any special, incidental, direct, indirect, consequential or punitive damages whatsoever, including, without limitation, damages for personal injury, wrongful death, loss of revenue, business interruption, loss of business information or any other pecuniary loss, loss of technology, loss of rights or services, loss of data, interruption or loss of use of any equipment, mental anguish, emotional distress, or invasion of privacy, arising out of the use of or inability to use our site and/or the products and services provided through our site, even if we have been advised of the possibility of such damages, whether under theory of contract, tort (including negligence), strict liability, or otherwise.

We are not responsible or liable for the acts or omissions of information, or for performance (or non-performance) within outside networks or interconnection points between our site and other networks and/or sites that are operated by third parties. We also make no representation regarding your ability to transmit and receive information from or through our site, and you agree and acknowledge that at times your ability to access our site may be impaired or disrupted. Although we will use commercially reasonable efforts to take any action we consider appropriate to remedy and avoid such events, we cannot guarantee that they will not occur, and accordingly we disclaim any and all liability resulting from or related to such events.

We are not liable for any failure or delay in our performance due to any cause beyond our reasonable control, including acts of war, acts of God, earthquake, flood, embargo, riot, sabotage, labor shortage or dispute, governmental act or failure of the internet.


You agree to defend, indemnify and hold ReliaCare and its directors, officers, employees, agents, affiliates and successors harmless from and against any and all claims, demands, liabilities, judgments, losses, damages, costs, fees and expenses (including but not limited to reasonable attorneys' fees) arising from or relating to your use of the site or your acts or omissions, including but not limited to: (1) infringement or misappropriation of any intellectual property rights, (2) defamation, libel, slander, obscenity, pornography, or violation of the rights of privacy or publicity, (3) spamming, or any other offensive, harassing or illegal conduct or violation of this Agreement, or (4) any damage or destruction to our site, to us, or to other persons or parties.

Termination and Investigation

ReliaCare may terminate the license granted to you under the above "License and Website Access" section at any time if you are in breach of this Agreement. The license will terminate immediately without notice from ReliaCare if, in ReliaCare's sole discretion, you fail to comply with any term or provision of this Agreement. Upon such termination, you may not access, use, or view the site.

We reserve the right to investigate suspected violations of this Agreement. If we become aware of possible violations, we may initiate an investigation that may include gathering information from you or any user involved and the complaining party, if any, and examination of other material. We may suspend the provision of our services temporarily, or we may permanently remove the material involved from our servers, cancel posts, provide warnings to you, or suspend or terminate your access to our services. We will determine what action will be taken in response to a violation on a case-by-case basis, and at our sole discretion. We will fully cooperate with law enforcement authorities in investigating suspected lawbreakers.


You hereby acknowledge that your breach of this Agreement may result in immediate and irreparable harm to ReliaCare, for which there will be no adequate remedy at law, and that ReliaCare shall be entitled to equitable relief to compel you to cease and desist all unauthorized use, evaluation and/or disclosure of information obtained through the site. Your breach of this Agreement may also entitle ReliaCare to bring an action against you for any and all other remedies available at law or in equity.

Assignability & Non-transferrable Rights

We may assign our rights and delegate our duties under this Agreement either in whole or in part at any time, at our sole discretion, and without your consent. You may not assign, sublicense or otherwise transfer your rights or obligations, in whole or in part, under this Agreement to anyone else.


We operate and control our site from our location in New York, United States of America. We make no representation that any information, materials or functions included on or through our site are appropriate for use in any other jurisdiction. If you choose to access our site from locations other than New York, you do so under your own initiative and are responsible for compliance with applicable laws and regulations.

This Agreement, and the rights and obligations of you and ReliaCare hereunder, shall be governed by, and construed in accordance with, the laws of the State of New York. You further agree that any legal action or proceeding between you and ReliaCare arising out of or relating to this Agreement or your use of the site shall be brought exclusively in a federal or state court of competent jurisdiction sitting in New York, New York, and you hereby expressly and irrevocably consent to the jurisdiction and venue of such courts.

No Waver, Severability

A waiver of any breach of any provision of this Agreement shall not be deemed to be a waiver of any repetition of such breach or in any manner affect any other terms or conditions of this Agreement. In the event that any provision of this Agreement is held to be unenforceable, it will not affect the validity or enforceability of the remaining provisions and will be replaced by an enforceable provision that is the closest to the intention underlying the unenforceable provision.
